Introduction

NARELLAN POOLS PTY LTD & NARELLAN FRANCHISE PTY LTD and its franchisees (Narellan Pools) see the importance of privacy to the organisation, its customers and other stakeholders. As such Narellan Pools committed to protecting the privacy of the personal information that they hold. This is part of the organisations:

Legal obligations under the Privacy Act 1988;
Ethical and business obligations; and
Service to its customers.

Our Objective

Narellan Franchise operates a franchise system that distributes Pools & Products to its franchisees for supply to its customers.

Narellan Pools collects the following personal information from customers:

Name
Address
Telephone Numbers
Any further personal details that may be given to us from other organisations or persons for the purposes of providing our full range of services.

Some information collected may be used for statistical research to improve the services that we provide to our customers. In such cases we de-identify all the information to ensure anonymity. Should any personal information be needed we would seek prior consent before proceeding any further.

We may also use personal information to communicate company matters, products, services and special promotions that might be relevant. People wishing not to receive such information should make clear their request to 'opt out' of receiving this type of information.

We collect the information to:

obtain any necessary Council and Waterboard approvals.
take out building insurance
sell our products and services (including quotations, information packs, warranty issues)
process payment · enable sub-contractor works to be carried out.
pass on to a supplier in regard to equipment claims or repairs
allocate the manufacturing of goods to the customer
allocate the sale or lead to franchisee to carry out works
monitor sales that occurs in set regions

We may also collect the information on testimonials and present them to other prospects as a marketing tool.

Also in dealing with personal information we may be required by law to disclose information to certain government bodies, insurance companies and provide information where required by subpoena.

Narellan Pools will generally not disclose your information without your consent where it is to be used for services not related to the primary purpose. Where we intend to use your information for such additional purposes we will request your consent to use your information for the identified purpose to be issued to you prior to use of that information.

Narellan Pools also reserves the right to transfer all personal information held by it whereupon the organisation is assigned or transferred to a further party.

This privacy policy applies to related entities that are part of Narellan Pools. It cannot apply to parties that may be linked or associated with our organisation. Those parties are themselves responsible for the privacy of any information that they collect.

Access to your personal information

Narellan Pools will provide access by allowing to inspect, take notes of or receive copies or print outs of the personal information that Narellan Pools hold about you.

You can make your request in writing by contacting Narellan Pools, 16 Bellingham Street Narellan NSW 2567 or the applicable Franchised store.

To obtain access you will have to provide proof of your identity. This is necessary to ensure that personal information is provided only to the correct individuals and that the privacy of others is not undermined.

Access will be denied if:

the request does not relate to the personal information of the person making the request;
providing access would pose a serious and imminent threat to life or health of a person;
providing access would create an unreasonable impact on the privacy of others;
the request is frivolous and vexatious;
the request relates to existing or anticipated legal proceedings
providing access would prejudice negotiations with the individual making the request;
access would be unlawful;
denial of access is authorised or required by law;
access would prejudice law enforcement activities;
access discloses a 'commercially sensitive' decision making process or information; or
any other reason that is provided for in the National Privacy Principles (NPPs) set-out under the Privacy Act.

We will take all reasonable steps to provide access within 30 days of your request. In cases where the request is not complicated or does not require access to a large volume of information, we will provide information within 14 days.

For access to your personal information Narellan Pools will impose the following charges:

Photocopying - @ a Rate of 25 cents per copy
Access to electronic databases - @ a Rate of $45.00 per Hour.

Ensure the accuracy of information

We try to ensure that all information we hold about which we collect, use or disclose is accurate, complete and up to date. Providers must promptly notify us if there are any changes to your personal information.

Providers may ask us at any time to correct personal information held by us about them, which they believe is incorrect or out of date. We will deal with the request within a reasonable time.

Storage

We will take all reasonable steps to protect the security of the personal information that we hold. This includes appropriate measures to protect electronic materials and materials stored and generated in hard copy.

Changes to this policy

This policy may change from time to time. If we make any substantive changes to the policy concerning personal information, it will be communicated on the website.
